Terms of service
Who we are
Success Mentor is run by Untoshi Holdings (Pty) Ltd (registration number 2024/281530/07), Grootfontein Office Park, Pretoria, South Africa. In these terms, "we" and "us" mean that company, and "you" means the person using Success Mentor.
By creating an account or using the service, you agree to these terms and to our privacy policy.
Who can use Success Mentor
You must be 18 or older. Each account is for one person, and the details you give us must be accurate.
What Sam is, and is not
Sam is an AI mentor. It guides you through proven principles of personal and professional growth, drawing on a library of source material and on what you tell it about yourself.
Sam is not a person, and its guidance is not medical, psychological, legal or financial advice. It can be wrong. Decisions you make after talking to Sam are yours. For a health, legal or financial question, speak to a qualified professional.
If you are in crisis or thinking about harming yourself, contact emergency services or a crisis line straight away. Sam cannot help in an emergency.
Your account
You need to confirm your email address before you can chat with Sam. Keep your password to yourself; you are responsible for what happens under your account. If you think someone else has used it, tell us.
Plans
Success Mentor has two plans for individuals:
- Explorer is free. Sam remembers your conversation only until you log out or your session ends.
- Committed is paid. You get Sam's full depth, and Sam keeps your conversations and remembers your progress between them.
The current price and what each plan includes are on our pricing page.
Billing
The Committed plan is a monthly subscription in South African rand. Paystack, our payment provider, charges your card when you subscribe and again each month until you cancel. Your card details are held by Paystack, not by us.
If a monthly payment fails, Paystack will try again, and you keep access for a short grace period while it does. If the payment still fails, your account moves to Explorer.
If we change the price, we will tell you by email before the new price applies to you.
Cancelling
You can cancel the Committed plan at any time from your subscription page. Cancelling stops future payments and moves your account to Explorer straight away.
Cancelling permanently deletes all your saved conversations and your journey summary. They cannot be recovered. If you want to keep anything from them, copy it before you cancel.
Cancelling does not automatically refund a payment you have already made. If you think you are owed a refund, contact us. Nothing in these terms limits your rights under the Consumer Protection Act.
Company Access
Your employer can pay for your access through Company Access. While they do, you have the Committed plan and they are billed, not you. If you already pay for the Committed plan yourself, that subscription is cancelled when your employer's access starts, and your conversations are kept.
Your employer can see that you hold a seat, but cannot read your conversations. The privacy policy sets out exactly what they can see.
If your employer stops paying for Company Access, your account moves to Explorer and your conversations are kept. If your employer removes you from their Company Access, your account is deleted, including your conversations.
Acceptable use
When you use Success Mentor, you agree not to:
- break the law, or use the service to harm or harass anyone;
- share your account, or sell or resell access to it;
- try to get around the service's limits or security, or disrupt it for other people;
- use automated tools to collect Sam's replies or the site's content in bulk;
- use Sam's replies to build a competing service.
What belongs to whom
What you write to Sam stays yours. You allow us to store and process it only to provide the service to you, as the privacy policy describes.
Sam's replies are yours to use in your own life and work. The site, the Success Mentor name, our articles and the way Sam is built belong to us.
Our liability
We work to keep Success Mentor available and accurate, but we provide it as it is. We cannot promise it will never be interrupted or that Sam will never make a mistake.
As far as the law allows, we are not liable for indirect or consequential loss, or for decisions you make based on Sam's guidance. Our total liability to you is limited to what you paid us in the 12 months before the claim.
Nothing in these terms excludes or limits a right you have under the Consumer Protection Act or any other law that cannot be excluded.
Suspending or closing accounts
We may suspend or close an account that breaks these terms. Where it is fair to, we will tell you first and give you a chance to put it right.
You can ask us to close your account at any time by emailing wim@untoshi.com. Closing it deletes your information as the privacy policy describes.
Changes to these terms
We may update these terms as the service changes. We will update this page and its effective date, and if a change is significant we will tell you by email before it takes effect. Using Success Mentor after a change takes effect means you accept the new terms.
Governing law
These terms are governed by the law of the Republic of South Africa, and South African courts have jurisdiction over any dispute about them.
